privacy policy

01 Introduction

This Privacy Policy explains how Kaius, Inc ("Kai," "we," "us," or "our") collects, uses, and shares information about you when you use the Kai mobile application and related services (the "Service"). By using the Service, you agree to the practices described here.

In short: we collect the information you give us when you sign up and complete quests (including the photos and videos you submit), along with limited technical and location data. We use it to run Kai, verify quests, pay your rewards, keep the platform safe, and meet our legal obligations. Our legal bases are performing our contract with you, your consent (for example, for precise location), our legitimate interests in operating and securing the Service, and compliance with law. We do not sell your personal information.

02 Information we collect

Information you provide. Account details such as your name, email address, date of birth, and payment or payout information; the photos, video, and other content you submit to complete quests; and any messages you send to support.

Information collected automatically. Device identifiers, app usage and interaction data, approximate or precise location (with your permission), and diagnostic logs.

Location data. With your consent, we use your device location to surface side quests near you. You can disable location access at any time in your device settings.

We work with a limited set of service providers that process data on our behalf, which may include cloud hosting and storage, analytics and crash reporting, identity and fraud-prevention checks, payment and payout processing, and customer-support tooling. These providers may only use your information to perform services for us. A current list is available on request at hello@app-kai.com.

03 How we use information

  • To operate the Service — show nearby quests, accept submissions, and deliver rewards.
  • To verify quest completion and prevent fraud or abuse.
  • To process gift cards, coins, and payouts.
  • To communicate with you about your account, rewards, and updates.
  • To improve and develop new features.
  • Send you optional marketing about new quests, rewards, and features (you can opt out at any time); personalize the quests and content you see; run surveys and product research; and comply with legal, tax, and regulatory obligations.

04 How we share information

We may share information with service providers who process data on our behalf (e.g. payments, cloud hosting, analytics), with the brands or partners who sponsor specific quests where you have submitted content, and as required by law or to protect our rights.

We do not sell your personal information for money, and we do not "share" it for cross-context behavioral advertising as those terms are defined under the California Consumer Privacy Act (CCPA/CPRA). If this ever changes, we will update this policy and provide any opt-out the law requires.

Text messaging. When you provide your mobile number to receive verification codes, we do not share that mobile information (including your phone number and your SMS opt-in or consent) with third parties or affiliates for marketing or promotional purposes. We share it only with service providers acting on our behalf to deliver the messages, such as our SMS provider, and as required by law.

05 Rewards & payments

When you earn gift cards, coins, or cash rewards, we collect the information needed to deliver them and to meet tax or regulatory obligations. We use third-party payment and gift-card providers to deliver your rewards, and we may verify your identity before paying out to prevent fraud. Where required by law, we collect tax information (for example, a Form W-9 for U.S. contributors) and may issue tax forms such as a 1099 once your earnings reach the applicable reporting threshold in a calendar year. You are responsible for any taxes on the rewards you earn.

06 Data retention

We retain personal information for as long as your account is active and as needed to provide the Service, then for up to 7 years after your account is closed to meet tax, accounting, fraud-prevention, and other legal obligations — and longer where the law requires.

07 Your rights & choices

Depending on where you live, you may have the right to access, correct, delete, or port your personal information, and to object to or restrict certain processing. To exercise these rights, contact us at hello@app-kai.com.

If you are in the EEA or UK, you have rights under the GDPR including access, rectification, erasure, restriction, portability, objection, and the right to lodge a complaint with your local supervisory authority. If you are a California resident, you have rights under the CCPA/CPRA to know, access, delete, and correct your personal information and to not be discriminated against for exercising them; residents of other U.S. states with privacy laws may have similar rights. To exercise any of these rights, contact us at hello@app-kai.com — we will verify your request and respond within the timeframes the law requires.

08 Children's privacy

The Service is not directed to children under 18, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us so we can delete it.

09 Security

We use technical and organizational measures designed to protect your information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

10 International transfers

We are based in the United States and may process information in countries that may not provide the same level of data protection as your home country. When we transfer personal information out of the EEA or UK, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses (and the UK Addendum) or another lawful transfer mechanism. You can request a copy of the relevant safeguards by contacting us at hello@app-kai.com.

11 Changes to this policy

We may update this Privacy Policy from time to time. We will post the revised version with a new "Last updated" date and, where required, provide additional notice.
